Terms of Service

These Terms of Service govern your access to and use of the TrustDesk platform and website. By using the service, you agree to these terms.

1. Acceptance of terms

By accessing or using TrustDesk, you agree to be bound by these terms. If you use the service on behalf of an organization, you accept these terms for that organization and confirm you are authorized to do so.

2. The service and your subscription

TrustDesk is a software-as-a-service platform for building and operating a Trust Center, automating compliance, and managing security evidence.

We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these terms and the plan you subscribe to.

3. Enterprise and professional services

Where you purchase an enterprise plan or professional services under a separately signed agreement (such as an order form or master services agreement), that agreement governs and takes precedence over these terms to the extent of any conflict.

4. Accounts and responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate information, keep it up to date, and notify us promptly of any unauthorized access or suspected security incident.

5. Plans, billing and renewals

Paid plans are billed in advance for the interval you select and, unless stated otherwise, renew automatically until cancelled.

Fees are non-refundable except where required by law or expressly stated. We may change plan pricing on renewal with reasonable notice.

6. Acceptable use

Your use of the service must comply with our Acceptable Use Policy, which forms part of these terms. You agree not to misuse the service, interfere with its operation, or access it other than through the interfaces we provide.

7. Customer content and intellectual property

You retain all rights in the content you upload. You grant us the rights needed to host and process that content solely to provide the service.

TrustDesk and its licensors retain all rights in the platform, brand, and underlying software. These terms do not transfer any TrustDesk intellectual property to you.

8. No professional advice

Information provided on our website and within the service is for general informational purposes and does not constitute legal, regulatory, or professional advice. You are responsible for determining your own compliance obligations.

9. Third-party links and services

The service may link to or integrate with third-party websites and services. We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk.

10. Availability and changes

We work to keep the service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features, and we may update these terms from time to time; continued use after changes take effect constitutes acceptance.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, the service is provided "as is" without warranties of any kind, and our aggregate liability is limited as set out in your agreement with us.

12. Governing law

These terms are governed by the laws applicable to the TrustDesk contracting entity that provides the service to you, without regard to conflict-of-law principles.

13. Termination

Either party may terminate in accordance with the applicable agreement. Upon termination, your right to use the service ends, and we will handle your data as described in our Privacy Policy and Data Processing Addendum.
